Q. Is every case different?
A. Yes and no. Many fathers face the same issues such as false allegations of domestic violence, difficulties getting visitation consistent with their work schedules, and excessive child support and alimony demands. However, the facts of each case are always different. For example, some fathers work the night shift, some the day, some own their own business and some are the primary caretaker for the children and earn less than their wives. Also, in cases involving domestic violence, the facts are always different.

Q. Do I have to keep my current lawyer?
A. No. Every year Mr. Berkley is retained by many fathers when their current attorney has made a mess of the case. In most cases you can retain Mr. Berkley and he can retrieve your file from your current lawyer and you will not even have to speak with your current lawyer again.

Q. Are consultations free?
A. Yes. Since every case is different, Mr. Berkley encourages you to call him free of charge, to discuss the facts and issues in your particular case.

Q. Do I need grounds for divorce?
A. Since 2007 New Jersey has recognized irreconcilable differences, which means that you do not have to allege fault in order to obtain a divorce, simply that your marriage has broken down for 6 months and there is no likelihood of reconciliation. New York has also adopted irretrievable break down, so no fault needs to be alleged in a New York case either.
