UNCONTESTED DIVORCE
The term “Uncontested Divorce” refers to the fact that you and your wife have reached an agreement on all the outstanding terms of the divorce and there is no need to have the judge decide the issues for you. Generally speaking, this usually occurs after negotiations and the formal signing of a “Property Settlement Agreement” which is a contract between you and your wife that sets forth all the terms you have agreed to. Therefore, you must make sure you have a fair agreement. In the Uncontested Divorce, the Property Settlement Agreement becomes part of the actual Judgment of Divorce.
While about 97 percent of cases end in a settlement, and end in an uncontested divorce, many cases involve some form of Court intervention prior to the actual judgment of divorce being rendered. I call these “Hybrid” cases, because the case begins partially contested in the beginning (which means you may have to go to Court to get some of the issues resolved) but your case ultimately ends in a settlement. Some cases also do not settle until the day of trial.
The truly “contested divorce” is one whereby you cannot agree on a settlement and you must have a trial whereby the judge decides the terms of your divorce. This happens mostly when child custody cannot be resolved or when Alimony or equitable distribution cannot be agreed to. Contested Divorces are the most costly, time consuming and emotional.
