IRRECONCILABLE DIFFERENCES
In 2007, New Jersey adopted: “Irreconcilable Differences” as grounds for divorce. Irreconcilable Differences is also commonly known as the “no fault” divorce. It is now the most common used grounds in a complaint for divorce. The significance is that now, you (or your wife) no longer have to allege that your spouse has done something wrong against you (Extreme Cruelty) in order to get divorced, and you no longer have to allege abandonment, separation or adultery. All you have to establish is that your marriage has broken down for a period of six months or more and there is no likelihood of reconciliation. In 2010, New York caught up to New Jersey and adopted “Irretrievable Breakdown” as grounds for divorce, which is essentially the same as Irreconcilable Differences.
