PRENUPTIAL AGREEMENTS

A Prenuptial Agreement is a contract that you and your fiancé enter into before you get married so that in the event of a divorce, Alimony and Equitable Distribution can be avoided or kept to a minimum. You cannot, however, avoid paying Child Support by any agreement.

In order to have a Prenuptial Agreement stand up in Court, you will have to disclose all your assets and it is best if your wife has her own attorney review the agreement before she signs it. Also, it is best if it is not signed minutes before your Wedding. The more time she has to review it, the less likely a Court will throw it out for fraud or duress.

“Prenups” are best used when you have already accumulated assets or you are going into a second marriage. In a second marriage you should also use a Will to make sure at least half of your assets go to your children and not your second wife’s children from her prior marriage.
